8. Experimental Software

Most software published by NixBiz — including every desktop application, browser extension, and open-source project listed on this website — is experimental, provided free of charge, and offered as an unfinished personal project rather than a commercial product. By downloading, installing, or running any of it, you acknowledge and accept the following:

• It may contain defects, may behave unpredictably, may stop working after an operating system update, and may be discontinued at any time without notice or migration path.
• You install and run it entirely at your own risk, and you are responsible for backing up your data beforehand.
• Tools that rename, move, delete, compress, encrypt, or synchronise files can cause irreversible data loss if they malfunction or are used incorrectly.
• Builds are not code-signed. Windows SmartScreen, macOS Gatekeeper, or antivirus software may warn about or block them. You should only download from official NixBiz links, and you should never disable security software in order to run this software.
• It is not intended for, and must not be relied upon in, any safety-critical, medical, legal, financial, or otherwise regulated context, nor anywhere that failure could cause injury, loss, or legal exposure.
• Where a feature connects to a third-party service, you are responsible for your own credentials, API keys, usage costs, and compliance with that provider's terms.
• Being free of charge, the software carries no service level agreement and no guarantee of support, updates, or compatibility.

Where an individual project ships its own licence file, that licence governs the software itself and prevails over this section in the event of conflict.

9. Disclaimer of Warranties

ALL SOFTWARE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SOFTWARE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIXBIZ, ANAND BHANDARI, AND ANY AFFILIATES, CONTRIBUTORS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DATA LOSS, CORRUPTED OR DELETED FILES, LOSS OF PROFITS, BUSINESS INTERRUPTION, HARDWARE FAILURE, SECURITY INCIDENTS, OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR CONNECTED TO YOUR USE OF, OR INABILITY TO USE, OUR SOFTWARE OR SERVICES.

THIS APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE LEGAL THEORY ON WHICH A CLAIM IS BASED.

BECAUSE THE SOFTWARE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID US FOR THE SOFTWARE OR SERVICE GIVING RISE TO THE CLAIM, WHICH FOR FREE SOFTWARE IS ZERO, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. Where that is the case, the above exclusions and limitations apply only to the extent permitted by law, and nothing in these terms limits liability that cannot lawfully be limited.
